| The scene is a familiar one. You are cruising along, enjoying the radio by singing along, when you look into the rearview mirror and what do you see? Blue lights signaling that you are being stopped, so you pull over. The first thing you do is tell yourself not to panic. Unless you can talk yourself out of this one, you are going to get a traffic ticket. Now, the first thing that is on your mind is What did you do? Some people may not even realize that they were doing something wrong. Were you speeding or going too slow. Yes, you can get a traffic ticket for going too slow. If you will notice, especially on interstate highways, the minimum speed and maximum speed are displayed. So while you are sitting there pondering what you did, and the officer is approaching to tell you what your traffic offense was, do you plead innocence or confess and hope an apology will work. If you truly do not know why you are being stopped, pleading innocence will probably be your best bet. They can normally tell who is genuinely surprised by the stop and who feels guilty. If after inspecting your driver's license, registration, and insurance the officer will have it no other way than to write you a traffic ticket, accept it and fight it later. Which by the way, the ticket was for not coming to a complete stop at a stop sign. You could have sworn you did stop completely. Irregardless you are going to have to either pay a traffic fine or plead not guilty and throw yourself on the mercy of the judge. A traffic fine usually has a set amount for certain offenses. More serious offenses, such as reckless driving or running a red light may have a higher fine than others. Offenses that put other people in danger will carry a heftier traffic fine. Running a red light could cause a collision at a high rate of speed that could very well result in injury or death. Traffic offense means you did something that was not lawful. There are many. The best way to keep up with these is to go to your local Department of Motor Vehicles and get a book to study. It will tell you all the offenses and what the fines for violating these laws will be. If the offense is one that you could lose points on your license for, you might want to consult a traffic attorney. Fighting this traffic ticket in court is your best bet for getting it taken off your record. The traffic attorney can advise you of what your best options are. They can also tell you how much your fine will be. If this is indeed an offense for which you could have points taken from your driver's license, the best method to go about keeping that from happening can be explained to you by a traffic attorney. A traffic ticket is very serious business. Not only can it cause you to have to pay a huge traffic fine, but if you make a habit of getting tickets, you could be in danger of losing your driver's license. Traffic tickets are one reason that insurance is high. For boys more so than girls. At least until a certain age when the insurance companies figure they have matured enough to be more careful when they are driving. Some states, New York, for example have what is known as a traffic violation bureau. What this means is that certain parts of the state has a bureau that is a part of the Department of Motor Vehicles. This bureau is basically a traffic court. The judge who presides over matters brought before him is an administrative law judge. When matters are bought before him, he decides the verdict. Unlike most other courts, if one wants to appeal a decision rendered by the ALJ (administrative law judge), it is not sent to a higher court but to an appeals department in the Department of Motor Vehicles in Albany, New York. When you receive a traffic ticket and have to go to court, if the decision is made to suspend your driver's license, this process normally takes place through the DMV. However, in traffic violations bureau, the judge can take your license right then and there. One of the complaints about the this bureau is their high conviction rate. By finding so many people guilty, it raises the question about the ethics of this type of system. Lawyers in particular, are not very happy with it and they compare it to a kangaroo court. So this is probably one place that you do not want to end up going to court. The best way to avoid getting a traffic ticket is to obey the laws of the road. As stated before, if you are unsure of some of them, there are ways to find out what the laws are and if any current ones have been added. Letting traffic tickets pile up is not a good idea either. After so many, your license to drive can be revoked. If you do not go to court to either pay your traffic fine or contest it, the presumption will be that you are guilty. The court will find accordingly and a bench warrant may be issued for your arrest, depending on where you are when you get all the ticket. If you are going to be a responsible driver, you should try your best not to get a traffic ticket. Sometimes it may be unavoidable as it could be something as innocent as thinking the speed limit was higher than it actually was. However if you keep alert when driving, you should not have a problem with this. | |
